Pinkstaff v. Black & Decker (U.S.), Inc., 211 P.3d 698 (Colo. 2009): Represented Plaintiff in an action under the Colorado Wage Act. The Supreme Court of Colorado, in an orginal proceeding under C.A.R. 21, addressed discovery sanctions imposed against Defendants and their counsel, Holland & Hart and Steven Gutierrez. Case was remanded for trial, and ultimately settled in favor of the Plaintiff.
Kowalczyk v. Adkins, 2009 Colo. App. LEXIS 1990 (Colo. Ct. App. Mar. 19, 2009): Represented Plaintiffs in a state court action alleging civil theft against defendants arising out of a business contract. After successfully bringing an adversary proceeding in U.S. Bankruptcy Court in Colorado, the case ultimately was tried to the Court in Arapahoe County District Court. Judgment entered in favor of the Plaintiffs for more than $550,000, including interest and attorneys' fees incurred in the action. Decision upheld on appeal to the Colorado court of Appeals, and the judgment was amended to include an award of attorneys fees and costs incurred in connection with the appeal. Represented the Plaintiffs in connection with collection of the judgment amounts, including garnishments, contempt proceedings against Defendant for his failure to appear at scheduled post-judgment hearings, and post-judgment discovery.
